Protecting Clients through Due Diligence
It is expected that attorneys and their paralegals are aware of, familiar with, and capable of appropriately applying the Rules of Evidence. In litigation involving the Health Sciences or other complex fields of study, identifying, locating, and qualifying the right Expert Witness is sine qua non to success in advocating for one’s clients.
Each case is different. Your strategy must be freshly identified from your distinct fact pattern to the benefit of your client.
Expert witness searches are not particularly complicated once the appropriate field of expertise is identified. Even so; selecting an expert is as important as citing to “Good Law”. Persuasive Authority is not Controlling Authority.
The job of legal professionals is to find an Expert Witness a trier of fact will view as Controlling and not merely Persuasive.
